The Research of General Waste Clearance and Disposal Fee and Law Amendment.

The Plan consists of four parts on the general waste clearance and disposal fee system, including studies of the related regulatory frameworks: 1) Investigated the status of municipal governments’ and local municipalities’ General Waste Clearance and Disposal Fees: (1) Reviewed enforcement agencies’ (22 municipal environmental protection bureau) methods for calculating disposal costs and fees in 2013. Provided consultation for improvement. (2) Calculated proper disposal costs as stipulated in the Waste Disposal Act, revised and listed the cost items for reference by enforcement agencies.(3) Reviewed enforcement agencies’ usage of general waste disposal funds, and recommended proper funding allocation. (4)Estimated the necessary annual budget for enforcement agencies to maintain sufficient funding for future facility rehabilitation. Planned for contingencies when the rehabilitation fund is insufficient. (5) Drafted the “Calculation Guidelines of General Waste Clearance and Disposal Costs” for reference by the enforcement personnel at local municipalities. 2) Improvement of regulations for the disposal and clearance fees mandated by the Waste Disposal Act:(1) Collected General Waste Clearance and Disposal Fee regulations in accordance with legal process requirements. Reviewed the revision history of the regulations, and collected the disposal fee schedules levied by each municipality. (2) Examined the issues raised by local municipalities regarding general waste disposal and suggested solutions. (3) Reviewed the established interpretations of the Waste Disposal Act Articles 24 to 26 to draft suggestions for general policy. (4)Suggested improvements for the collection and management of waste disposal funds. 3) Reviewed and improved general waste related regulations (including laws, regulations and directives):(1) Surveyed executive agencies on the regulation of general waste clearance and disposal. (2) Analyzed Waste Disposal Act regulations regarding collection of clearance and disposal fees, the usage of collected disposal funds, and general waste recycling, clearance, and disposal guidelines. (3) Collected and analyzed government auditing reports (including central and local budget reviews). (4)Drafted a regulatory framework for the management of general waste according to the Waste Disposal Act. Compared between the Waste Disposal Act’s general waste disposal statutes with the proposed Resource Recycling Act’s general waste provisions. (5) Drafted proposals to resolve various administrative issues. 4) Supported the administration to improve the implementation quality and efficiency of the project:(1)Completed presentations, supporting documentation, and meeting records of EPA hearings and related meetings. (2)Answered and sorted out 15 administrative interpretation letters regarding Waste Disposal Act Article 24 disposal fee collection and Article 26 fund usage provisions. Summarized the issues and interpretations raised in each request. (3)Provided 20 legal opinions in support of EPA requests.
